All persons who intend to get married in New York State must obtain a Marriage License. This page explains the procedure for obtaining a Marriage License from the Town of Guilderland. Please read below for more information.


The fee for a Marriage License is $40 by Cash, Check, or Credit Card (fees apply).

Duration of the Marriage License

A New York State Marriage License is valid for 60 days (except for active military personnel, whose validity runs for 180 days). A Marriage License issued in New York can be used anywhere within New York State but may not be used outside New York State.

Application Procedure

Listed in the following are general steps and rules of the application process:

  • Your Marriage License will be processed while you wait.
  • You should carefully read your Marriage License before leaving the Clerk's window to ensure no errors.
  • Although the marriage license is issued immediately, the marriage ceremony may not occur within 24 hours from the exact time that the license was issued unless you obtain a Judicial Waiver.

Required Information

Listed in the following is the information you will need to fill out the Marriage License Application:

  • The application is an affidavit where you and your prospective spouse must list your name, current address, city, state, ZIP code, country; country of birth; date of birth; name and country of birth of your parents; Social Security number; and marital history.
  • When you sign the affidavit, you declare that there are no legal impediments to the marriage.
  • If you were married before, you must list all prior marriages. You must include your previous spouse's full name, the date the divorce decree was granted, and the city, state, and country where the divorce was issued. All divorces, annulments, and dissolutions must be finalized before applying for a new Marriage License. Please be advised, Certified copies of all Decree of Divorce will be required and must contain the "Judgment of Divorce" section.
  • If your spouse is deceased, a Certified Death Certificate will be required.

Proper Identification

You and your prospective spouse must have one item from each list provided:

Expired Identification is not acceptable.

  1. One form of Identification.
    • Valid Driver's license or Valid Non-Driver's I.D.
    • Valid Passport
    • Immigration record
  2. One form of proof of age.
    • Original or Certified Birth Certificate (with a raised or colored seal).
    • Original or Certified Baptismal record
    • Naturalization record
    • Census record
  3. Proof of Active Military Status.
    • Military I.D. Card.

Additional Information

  • You will receive a call back from the Clerk's office within 24 hours of submitting your application to set up an appointment
  • In addition, you will not receive an online confirmation after clicking submit.
